Lunchpets.com is a website owned by Wicked Cool Toys, LLC (“Wicked Cool”) that offers consumers direct access to purchase its amazing toy that doubles a lunch box: Lunch Pets™. Wicked Cool is a dynamic top toy company located in the United States, with a focus on developing and delivering high quality innovative products and brands that kids love!
Wicked Cool is sensitive to privacy issues, and it is important to us to protect the information provided to us. Please read the Lunch Pets™ Privacy Policy, which is incorporated by reference into Wicked Cool’s Terms and Conditions, to understand the privacy practices of Wicked Cool that apply to this Website. Wicked Cool provides this privacy and information practices policy to inform you about our online information practices, the kinds of information we may collect, how we intend to use and share that information, and how you can correct or change such information.

2. Personal Information We Process
We collect Personal Information that (a) you actively submit to us as a customer, (b) you actively submit to us in your interaction with the Website, (c) is collected automatically through your interaction with the Website, and (d) is collected through your interaction with third-party services.

(a) Actively Submitted Data as a Customer. We collect Personal Information from you, including contact information, such as your name and email address, and delivery information, such as the “deliver-to” name and mailing address, when you order a product on this Website. We use a third-party service provider to process your payment information and confirm payment as part of the check-out process. We will be unable to process your order if we do not receive this information. We also use a third-party service provider to fulfill your order and to email you when your order has shipped.

(b) Actively submitted data through Website interaction. We collect Personal Information from you including contact information, such as your name, phone number and email address when you request information about our products, make inquiries, request assistance from our customer service team, sign up for our newsletters and promotions, or otherwise communicate with us.

However, if you do that, the Website may not work properly. • Identifiers such as a real name, alias, postal address, unique personal identifier, online identifier, Internet Protocol address, email address, account name;
• Commercial information, including products or services purchased, obtained, or considered;
• Internet or other electronic network activity information, including, browsing history, search history, and information regarding a consumer’s interaction with an Internet Web site, or advertisement;
• Geolocation data.

3. Purposes for Processing Personal Information
We use your information for a variety of business purposes, including to:
(a) Fulfil our contract with you:
• Process your product order;
• Process payment information to facilitate product purchase and return;
• Deliver purchased product;
• Communicate with you about your order; and
• Process product return.
(b) Operate our business pursuant to our legitimate interest.

We may access, preserve, and disclose your Personal Information, other account information, and content if we believe doing so is required or appropriate to: (i) comply with law enforcement or national security requests and legal process, such as a court order or subpoena; (ii) respond to your requests; (iii) protect yours’, ours’ or others’ rights, property, or safety; (iv) to enforce Wicked Cool policies or contracts; (v) to collect amounts owed to Wicked Cool ; (vi) when we believe disclosure is necessary or appropriate to prevent physical harm or financial loss or in connection with an investigation or prosecution of suspected or actual illegal activity; or (vii) if we, in good faith, believe that disclosure is otherwise necessary or advisable.

In addition, from time to time, server logs may be reviewed for security purposes – e.g., to detect unauthorized activity on the Website. In such cases, server log data containing IP addresses may be shared with law enforcement bodies in order that they may identify users in connection with their investigation of the unauthorized activities.

(f) Merger, Sale, or Other Asset Transfers. If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, sale of company assets, or transition of service to another provider, then your information may be sold or transferred as part of such a transaction as permitted by law and/or contract. 5. Data Transfers
All Personal Information sent or collected via or by Wicked Cool may be stored anywhere in the world, including but not limited to, in the United States, in the cloud, our servers, the servers of our affiliates or the servers of our service providers. Your Personal Information may be accessible to law enforcement or other authorities pursuant to a lawful request. In the event that Personal Information is transferred outside of the United States of America, we will ensure that adequate protections are implemented such as implementing Standard Data Protection Clauses.

7. Storage of Personal Information
Personal Information is processed and stored at various locations including on servers located in the United States of America and throughout the world.
8. Data Retention
We retain the Personal Information we collect for a reasonable period of time to fulfil the processing purposes mentioned above. Personal Information is then archived for time periods required or necessitated by law or legal considerations. When archival is no longer required, Personal Information is deleted from our records. We retain Personal Information that we are required to retain in order to meet our regulatory obligations including tax records and transaction history. By using the Website or providing Personal Information to us, you agree that we may communicate with you electronically regarding security, privacy, and administrative issues relating to your use of the Website. If we learn of a security system’s breach, we may attempt to notify you electronically by posting a notice on the Website or sending an e-mail to you. 10. Children’s Information
The Lunch Pets™ Website is not directed to children under 18 (or other ages as required by local law) and we do not knowingly collect Personal Information from children. If you learn that your child has provided us with Personal Information without your consent, you may contact us as set forth below. If we learn that we have collected any Personal Information in violation of applicable law, we will promptly take steps to delete such information and cancel any product order placed by the child.
